Employer-provided Child Care Tax Credit

An important item for employers to consider in 2026 is the newly expanded employer-provided child care credit (IRC 45F). Originally enacted in 1986, the federal income tax credit was designed to encourage employers to invest in child care support for working families.
 
Effective for child care expenses incurred on or after January 1, 2026, the expanded credit increases the maximum annual benefit from $150,000 to $500,000 (up to $600,000 for eligible small businesses), raises the credit to 40% of qualified child care facility expenses (50% for small businesses), and maintains a 10% credit for child care resource and referral services. This expansion represents one of the largest federal investments in employer-supported child care in decades, making it more affordable for businesses to offer benefits such as child care, backup care, tuition subsidies, and referral programs while strengthening recruitment, retention, workforce well-being, and overall employer competitiveness.
